Terms of Service

These Terms of Service govern your use of fangtoothinstruments.com and any content, downloads, or services offered through it (the "Site"), operated by Jeff Davis d/b/a Fangtooth Instruments ("Fangtooth Instruments," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Use of our software products is governed separately by our End User License Agreement. Payment and delivery of purchases are governed by the terms of Moonbase, our merchant of record. Our handling of personal information is described in our Privacy Policy.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase from this Site. By placing an order you confirm that you meet that requirement.

2. Site content and intellectual property

All content on this Site — including text, product copy, logos, the Fangtooth Instruments name and marks, artwork, photographs, audio demos, videos, interface designs, and documentation — is owned by Fangtooth Instruments or used under license, and is protected by copyright and trademark law.

You may view, download, and print Site content for your own personal, non-commercial reference. You may not otherwise copy, reproduce, republish, sell, or create derivative works from Site content without our written permission.

You may share links to the Site freely, and you may use our product images and audio demos in reviews, tutorials, and editorial coverage.

3. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site, our servers, our licensing systems, or another user's account
  • Interfere with or disrupt the Site, including by scraping, automated data collection, denial of service, or introducing malicious code
  • Circumvent, disable, or attempt to defeat any security, licensing, or access control measure
  • Impersonate Fangtooth Instruments or misrepresent your affiliation with us
  • Resell or redistribute anything obtained from the Site except as expressly permitted

We may suspend or terminate access to the Site, and to associated licenses, for violations of these Terms.

4. Products and pricing

Product descriptions, system requirements, install sizes, specifications, and prices are provided in good faith and may change without notice. We try hard to be accurate, but we do not warrant that all Site content is error-free or current. If a product is listed at an obviously incorrect price, we reserve the right to cancel the order and refund it in full.

Introductory and promotional pricing is available only for the stated period. Prices are shown in the currency selected at checkout; applicable VAT or sales tax is calculated and added at checkout by our merchant of record.

5. Purchases

Purchases made through this Site are processed by Moonbase (Moonbase AS), acting as merchant of record. Moonbase concludes the sales contract with you, collects payment, handles tax and VAT, and provides initial delivery of the product. The software is licensed to you by Fangtooth Instruments under our End User License Agreement. Moonbase's buyer terms apply to the payment and delivery aspects of your purchase.

Refunds are addressed in our Refund Policy.

6. Accounts

Purchases create an account with our licensing provider, through which you download products and manage activations. You are responsible for keeping your account credentials secure and for activity that occurs under your account. Notify us promptly at support@fangtoothinstruments.com if you believe your account has been compromised.

7. Third-party links and embedded content

The Site links to and embeds third-party content, including video hosted on YouTube and storefront components provided by Moonbase. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is subject to their own terms and privacy policies.

8. Free downloads, demos, and beta software

Any free content, demo version, or pre-release software we make available is provided as-is, may be incomplete or unstable, and may be withdrawn at any time. Beta software should not be used in critical production work.

9. Support

We provide product support by email at support@fangtoothinstruments.com. We aim to respond promptly, but we do not guarantee any specific response time or that every issue can be resolved. Support is provided for current versions of our products on supported operating systems.

10. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FANGTOOTH INSTRUMENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST PROJECTS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In those jurisdictions, these limitations apply only to the extent permitted, and nothing here limits liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence. If you are a consumer, nothing in these Terms affects your mandatory statutory rights.

12. Indemnification

You agree to indemnify and hold harmless Fangtooth Instruments from any claims, damages, and reasonable legal fees arising out of your misuse of the Site or violation of these Terms.

13. Changes to these Terms

We may revise these Terms from time to time. The date at the top reflects the current version. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing law and venue

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to their jurisdiction.

If you are a consumer resident in the EU, EEA, or UK, this clause does not deprive you of the protection of mandatory provisions of the law of your country of residence, or of your right to bring proceedings in your local courts.

15. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, Refund Policy, and End User License Agreement, constitute the entire agreement between you and Fangtooth Instruments regarding the Site.
